A dispute between federal and state regulators over the legal status of prediction markets has reached the courts. The Commodity Futures Trading Commission (CFTC) filed a lawsuit on Tuesday to block Utah from enforcing its gambling ban against Kalshi, a prediction market platform.

This legal action makes Utah the tenth state the CFTC has sued regarding this issue. The commission argues that state laws interfere with the operations of exchanges it has registered. The agency claims federal law gives it sole authority over these markets, preventing states from using gambling statutes to shut them down.

The conflict stems from a lawsuit Utah filed in state court last week. State officials are seeking a court order to bar Kalshi from offering bets on sports, elections, and political events. Utah prohibits gambling, and state leaders maintain that Kalshi's product fits that definition.

Utah Attorney General Derek Brown, a Republican, characterized the company's presence in the state as a violation of local law. "Kalshi runs an online casino in Utah and calls it a prediction market. That violates Utah law," Brown said. He noted that Utah has banned gambling under its state constitution for 130 years.

The two sides have a history of legal clashes. Kalshi previously filed a preemptive lawsuit in federal court to stop Utah from enforcing its laws against the company. Utah won that case. Now the state must defend its position while the CFTC pursues its own suit to block the state's enforcement actions.

The CFTC stated that its lawsuit follows Utah's decision to file civil enforcement actions against CFTC-regulated markets. The commission argues that Utah's approach obstructs a decision made by Congress and interferes with the functioning of the exchanges it oversees.

The outcome of this case may affect other companies in the sector. A victory for Utah could create legal challenges for Polymarket, Kalshi's main rival. It could also impact sports betting sites like DraftKings and FanDuel. Both companies advertise availability in all US states and are registered with the CFTC, placing them in the same category of operators the agency says states cannot target.
